Easyart.com Terms and Conditions

Our Agreement

Although we tried to avoid it, our lawyers told us there was no way we could be in business without setting out the terms of this agreement. This agreement is a legal document which sets out your rights and obligations, and those of Easyart, in relation to the fantastic services offered by us through this site or any of the other Easyart sites to which we link.

Effect of this agreement

Viewing of the Easyart site itself is free; but when you register for the site, you agree to the terms of this agreement, and you re-affirm that agreement every time you use the Easyart services, so we recommend you read this agreement so you know what you're getting yourself into.

Applicable law

We think England is the greatest and so: Easyart is a company registered in England, and every sale shall be deemed to be performed in England;

English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and we submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.

Making a contract with us

In return for the excellent service we will give you, we ask that you agree to register for Easyart sales using your correct name, address and any other requested details. You may be asked to enter credit, debit or charge card details. You must ensure that (a) you are fully entitled to use that card at the time when you provide those details to Easyart, and when you use the card, and b) the card has available funds to cover all charges incurred on it in the course of buying from us. If any of the information you enter becomes incorrect or is superseded, then please notify us with the corrected information immediately.

In any event, to register for Easyart services, you must legally be able to enter into contracts for goods and services that you may buy here. Generally, this means that you must be at least 18 years old and sane.

Misuse of our site

Don't mess with us. Easyart reserves the right to suspend or terminate any members account which, is, or appears to us in our absolute discretion, to be, in breach of any of the provisions of this agreement.

When will you be charged?

Your credit or debit card will not be charged until your goods are sent.

Tax & Duties

We will reluctantly have to charge VAT on all goods and services where applicable. And if you want your purchase to be delivered outside the European Union, you will automatically be responsible for paying all applicable duties. Sorry!

Corrections

You may think we are just making this stuff up but in fact, descriptions of goods and services included in the Easyart site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should know that the colors and appearance of images, mounts and frames may vary very slightly from the way they appear on the screen. Also print sizes can vary slightly with each production run. If you need to know the precise dimensions of a product, please contact us.

Copyright

We took a long time playing with our crayons and thinking about them, so you accept that the images and designs used on the Easyart website are the property of Easyart or their respective copyright owners, and are used by Easyart pursuant to express authorisation from copyright owners or their agents. You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to Easyart are vested in Easyart or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever. Not only will this make us throw our toys around but, in the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an interim injunction will be an appropriate remedy. An Interim injunction is a court order, which would prevent any further use or distribution of the image that we are concerned about, until a final court hearing where the court will make a decision on all the facts. And that won't be pretty.

Loss

Our lawyer told us we had to put this in, so please be aware that we will not be liable to you or any third party for any indirect or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused.

You also agree that the liability of Easyart under this agreement (whether arising in negligence or otherwise), will not under any circumstances exceed the greater of a) £500 or b) an amount equal to the sums paid or payable by you.

This does not affect your statutory rights as a consumer.

Consequential Loss

In the event of consequential loss, Easyart can only be responsible for the cost of your order.

Negligence

Although we couldn't think of any way this could possibly happen, we thought we should state that nothing in this agreement limits Easyart's liability for personal injury or death resulting from our negligence.

Reasonable Control

Easyart shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control. Without limiting ourselves here in any way, we were thinking of a hand of God, or alien invasion.

Changes to this Agreement

Due to the fact that some clever clogs is always coming up with new rules and regulations, Easyart reserves the right to change the terms of this agreement from time to time, and post a new version on our website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without notice.

Severability

In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.

Easyart Ltd is a Company registered in England under registration number 3850720, at The Lightwell, 12-16 Laystall Street, London EC1R 4PF.

Security and Privacy

We know you're concerned about security and privacy. We want to reassure you that any information you give us during the registration or ordering process as well as any that we know about you by other means will be well protected. We also feel it is important that you know exactly how any information you give us is used and that all information is collected lawfully and in accordance with the Data Protection Act 1998.

How we use your data

The privacy policy forms part of the agreement between us, and by purchasing goods from our site, you agree to be bound by the terms and conditions of the agreement between us. You also give your consent to the way we may handle your personal data in the way stated in this policy statement. Easyart will not use this data, or disclose it to any other party, either during registration or at any other time, without your express permission, given during registration or at some other time.

We may also contact you in respect of special offers or competitions, but only if you have elected to receive this by checking the opt-in box during the registration procedure or competition entry page, or entered your email address on the home page mailing list submission. You may unsubscribe from our contact list at any time by replying to a promotional email with the word “unsubscribe” in the subject line or by e-mailing us at customercare@easyart.com.

To provide a service that meets our customer needs, we may collect personal data relating to the popularity and usage of particular aspects of the site or related Easyart sites. However this data will be used or aggregated only on an anonymous basis.

How we protect your data

Any credit card information you give us will be held at a secure and separate site, and once we have authorised your purchase, we will delete part of the number and details, so that even in the highly unlikely event that our site security was breached for any reason your credit card details would be unusable.

We use cookies to save your password for each session, so you don't have to re-enter it each time you make a purchase. We also use cookies to track how our site operates and how it is used.
